Politická reflexia uskutočňovaná v akademických kruhoch predstavuje rad vlastných charakteristík v porovnaní s inými druhmi intelektuálnej činnosti. Nejde len o j e j viac-menej prirodzené preniknutie do domácich mocenských vzťahov, ale o mimoriadnu citlivosť j e j obsahu a rozvoja na spoločenské a politické podmienky inštitucionálneho kontextu. O politickej kultúre krajiny sa môžeme naučiť veľa práve na základe analýzy toho, o čom j e j intelektuáli diskutujú - a o čom nediskutujú, ako aj o teoretických nástrojoch, ktoré pritom využívajú.

Tato práce se zabývá možnými přístupy k etice sexuality, jejich klady i zápory. Etikou sexuality zde není míněno moralizování, stejně tak sexualitou není míněn pouze koitus, pohlavní chování je zde míněno v širším významu tedy včetně rozlehlé oblasti lidského svádění, okolků či otálení. Popsány jsou čtyři klasické přístupy k etice sexuality: tradicionalistický, romantický, marxisticko-feministický a liberální, avšak uvážen je i přístup antinatalistický, který vyplývá z asymetrického argumentu Davida Benatara uveřejněného v jeho práci Nebýt či být. Benatarův antinatalizmus totiž vytváří (...) etiku pohlavního chování, v níž pouze sex, který nevede k rozmnožení, může být morální. I když je tento pátý, antinatalistický přístup značně kontroverzní a zdaleka ne intuitivní, extrémnost jeho pozic se příliš neliší od tradicionalistického pohledu, v němž je morální pouze sex k rozmnožení vedoucí, tyto dva přístupy tak lze postavit do přímé opozice jako dvě krajní možnosti uvažování o etice pohlavního chování. Roli střední cesty v takovém řazení potom zaujme liberální přístup, který jako jediný etiku sexuality nevidí jako etiku odlišnou od jiných lidských činností. (shrink)

Kvalitný život ľudí v spoločnostiach značne závisí od ekonomiky, pričom vzhľadom na zabezpečenie humánneho a sociálno-ekonomického rozvoja ľudí a ľudskej spoločnosti súčasnú ekonomiku je potrebné humanizovať. V tejto súvislosti sa štúdia zameriava na dva dôležité predpoklady – renesanciu hlavného cieľa ekonomiky a humánny prístup k ľudským zdrojom, ktoré sa v súčasnej ekonomike zameranej na zisk a ekonomickú prosperitu, čoraz viac dostávajú do úzadia. Opiera sa o názory ekonóma L. von Mises, ale načrtáva aj názory súčasných ekonómov a predstaviteľov sociálno-humanitných (...) vied, ktoré sa stávajú podnetmi pre zamyslenie sa nad skutočnými dôvodmi pre renesanciu základného cieľa ekonomiky a tiež pre zabezpečenie humánnych prístupov k ľudským zdrojom, a napokon pre zreformovanie celej ekonomiky v prospech človeka. Tak, aby sa aspoň čiastočne priblížila k morálnemu ideálu, ktorý predstavuje model humanistickej ekonomiky. (shrink)

Many scholars and activists seek to eliminate “race”—the word and the concept—from our vocabulary. Their claim is clear: because science has shown that racial essentialism is false and because the idea of race has proved virulent, we should do away with the concept entirely. Michael O. Hardimon criticizes this line of thinking, arguing that we must recognize the real ways in which race exists in order to revise our understanding of its significance. Rethinking Race provides a novel answer to the (...) question “What is race?” Pernicious, traditional racialism maintains that people can be judged and ranked according to innate racial features. Hardimon points out that those who would eliminate race make the mistake of associating the word only with this view. He agrees that this concept should be jettisoned, but draws a distinction with three alternative ideas: first, a stripped-down version of the ordinary concept of race that recognizes minimal physical differences between races but does not consider them significant; second, a scientific understanding of populations with shared lines of descent; and third, an acknowledgment of “socialrace” as a separate construction. Hardimon provides a language for understanding the ways in which races do and do not exist. His account is realistic in recognizing the physical features of races, as well as the existence of races in our social world. But it is deflationary in rejecting the concept of hierarchical or defining racial characteristics. The situationist literature in psychology claims that conduct is not determined by character and reflects the operation of the agent's situation or environment. For instance, due to situational factors, compassionate behavior is much less common than we might have expected from people we believe to be compassionate. This article focuses on whether situationism should revise our beliefs about moral responsibility. It assesses the implications of situationism against the backdrop of a conception of responsibility that is grounded in norms about the (...) fair opportunity to avoid wrongdoing that require that agents to be normatively competent and possess situational control. Despite the low incidence of compassionate behavior revealed in situationist studies, situationism threatens neither situational control nor normative competence. Nonetheless situationism may force revision of our views about responsibility in particular contexts, such as wartime wrongdoing. Whereas a good case can be made that the heat of battle can create situational pressures that significantly impair normative competence and thus sometimes provide a full or partial excuse, there is reason to be skeptical of attempts to generalize this excuse to other contexts of wartime wrongdoing. If so, moral responsibility can take situationism on board without capsizing the boat. (shrink)

In this article, we describe a hitherto undocumented fallacy-in the sense of a mistake in reasoning-constituted by a negativity bias in the way that people attribute motives to others. We call this the "worst-motive fallacy," and we conducted two experiments to investigate it. In Experiment 1, participants expected protagonists in a variety of fictional vignettes to pursue courses of action that satisfy the protagonists' worst motive, and furthermore, participants significantly expected the protagonist to pursue a worse course of action than (...) they would prefer themselves. Experiment 2 was a preregistered attempted replication of Experiment 1, including a bigger range of vignettes; the first effect was not replicated for the new vignettes tested but was for the original set. Also, we once again found that participants expected protagonists to be more likely than they were themselves to pursue courses of action that they considered morally bad. We discuss the worst-motive fallacy's relation to other well-known biases as well as its possible evolutionary origins and its ethical consequences. (shrink)

This paper presents a literature review on the ethics of self-tracking technologies which are utilized by users to monitor parameters related to their activity and bodily parameters. By examining a total of 65 works extracted through a systematic database search and backwards snowballing, the authors of this review discuss three categories of opportunities and ten categories of concerns currently associated with self-tracking. The former include empowerment and well-being, contribution to health goals, and solidarity. The latter are social harms, privacy and (...) surveillance, ownership control and commodification of data, autonomy, data-facilitated harm, datafication and interpretability of data, negative impact on relation to self and others, shortcomings of design, negative impact on health perception, and regulation and enforcement of rules. The review concludes with a critical analysis of the existing literature and an overview of a future research agenda that could complement the current work on ethics of self-tracking. (shrink)

It has been widely accepted that intentional actions are “the actions to which “a certain sense of the question ‘why?’ is given application” (Anscombe 1957/2000: 9). But there are robust reasons for thinking that this claim is false. First, there are intentional actions for which such questions are unsound. We have good reasons for thinking that the questions are not “given application” in these cases. Second, when these questions are “given application” this is best explained, it is argued, not in (...) terms of a necessary link between intentional action and this type of enquiry, but in terms of the fact that this is an enquiry that we pursue when we take an agent to have exercised certain of their rational capacities. We address the question of whether and to what extent explanatory and modelling strategies in systems biology are mechanistic. After showing how dynamic mathematical models are actually required for mechanistic explanations of complex systems, we caution readers against expecting all systems biology to be about mechanistic explanations. Instead, the aim may be to generate topological explanations that are not standardly mechanistic, or to arrive at design principles that explain system organization and behaviour in general, but not specific mechanisms. These abstraction (...) strategies serve various aims, including prediction and control, that are central to understanding the epistemic diversity of systems biology. (shrink)

National Book Award Finalist. How did humanity originate and why does a species like ours exist on this planet? Do we have a special place, even a destiny in the universe? Yet alarmed that we are about to abandon natural selection by redesigning biology and human nature as we wish them, Wilson soberly concludes that advances in science and technology bring us our greatest moral dilemma since God stayed the hand of Abraham. R&D collaborations between industry, government, civil society, and research ) have recently gained attention from R&D theorists and practitioners. In aiming to come to grips with their complexity, past models have generally taken a stakeholder-analytical approach based on stakeholder types. Yet stakeholder types are difficult to operationalise. We therefore argue that a processual model is more suited for studying the interaction in QHCs because it eschews matters of titles and identities. We develop such a model in which the QHC is (...) represented as a process of generating four types of value: research value, market value, political value, and societal value. We then apply this processual model in analysing real-life cases of friction in QHCs. Friction is seen, not as an interpersonal clash, but as a discrepancy between two or more value-creation processes that compete for limited resources. (shrink)

In chapter 3 of Wild Animal Ethics Johannsen argues for a collective obligation based on beneficence to intervene in nature in order to reduce the suffering of wild animals. In the same chapter he claims that the non-identity problem is merely a “theoretical puzzle” which doesn’t affect our reasons for intervention. In this paper I argue that the non-identity problem affects both the strength and the nature of our reasons to intervene. By intervening in nature on a large scale we (...) change which animals come into existence. In doing so, we enable harmful animals to inflict harms on other animals, and we put other animals in harm’s way. The harms that these animals will inflict and endure are foreseeable. Furthermore, since non-human animals aren’t moral agents, harmful animals cannot be morally responsible for their harmful actions. I argue therefore that by causing animals to exist, knowing that they will inflict and suffer harms, we become morally responsible for those harms. By engaging in identity-affecting actions then we take on secondary moral duties towards the animals we have thereby caused to exist, and these secondary moral duties may be extremely demanding, even more so than the initial costs of intervention. Finally, these duties are duties of justice rather than duties of beneficence, and as such are more stringent than purely beneficence-based moral reasons. Furthermore, this conclusion flows naturally from several plausible principles which Johannsen explicitly endorses. (shrink)

When a patient lacks sufficient capacity to make a certain treatment decision, whether because of deficits in their ability to make a judgement that reflects their values or to make a decision that reflects their judgement or both, the decision must be made by a surrogate. Often the best way to respect the patient’s autonomy, in such cases, is for the surrogate to make a ‘substituted’ judgement on behalf of the patient, which is the decision that best reflects the patient’s (...) values and identity-infused beliefs as they were when the patient last possessed capacity. It is by now well-known that there is troubling evidence that surrogates do only slightly better than chance at making accurate substituted judgements. The use of a patient preference predictor, an algorithm that predicts patient preferences based on characteristics like the patient’s age, gender, socioeconomic status and education level, could help. Rid and Wendler have done important work making a moral case for using the PPP.1 If it were shown to enhance accuracy, it is not at all obvious what objections there could be to its use. Yet several subtle criticisms of the PPP have emerged in the literature. In their feature article, Jardas, Wasserman and Wendler select six of the most prominent objections to the PPP in the literature and defend the PPP against them.2 Along the way they make significant contributions to broader issues concerning the proper uses of statistical evidence and limits on the kinds of preferences there can be reasons of autonomy to respect. Since I found the authors’ answers to the final two objections—that the PPP relies on naked statistical evidence and that it uses non-endorsed reasons—to be especially interesting and provocative, I will examine those answers and raise a few questions about …. Philosophers of science discuss whether theory selection depends on aesthetic judgments or criteria, and whether these putatively aesthetic features are genuinely extra-epistemic. As examples, judgments involving criteria such as simplicity and symmetry are often cited. However, other theory selection criteria, such as fecundity, coherence, internal consistency, and fertility, more closely match those criteria used in art contexts and by scholars working in aesthetics. Paying closer attention to the way these criteria are used in art contexts allows us to understand some (...) evaluative and developmental practices in scientific theory selection as genuinely aesthetic, enlarging the scope of the goals of science. Where exactly did Hegel go wrong on race? Moellendorf helpfully tells us that Hegel's treatment of race begins systematically in the Philosophy of Subjective Spirit and that he went wrong philosophically in the use of the biological category of race. This is basically correct but requires precisification. This article considers why Hegel's category of race is not unambiguously biological. Race's biological status can be problematized from the standpoint of contemporary biology and from the standpoint of Hegel's system. The textual placement (...) of Hegel's systematic discussion of race in the philosophy of spirit makes clear that Hegel conceived of race in spiritual terms. Hegel took race to be a biospiritual category. Hegel was clearly committed to the now-controversial proposition that there is such a thing as human biological race, that there is a plurality of biological human races. He regarded race as a robust natural kind. His preferred list of races includes Caucasians, Negros, Mongolian, Malaysians and Americans. One noteworthy feature of his understanding of race's physical aspect was his focus on the formation of the skull and the face. At the same time, he clearly held that there were other deeper physical differences that accounted for the spiritual differences of race. Hegel was perfectly clear that race has a spiritual as well as physical aspect. He held that that the members of racial groups essentially shared certain fundamental, heritable, moral, intellectual and cultural characteristics with one another that they did not share with members of any other race and that these differences were such as to support an objective ranking. This shows that Hegel took the category of race to be the sort of category we today would characterize as ‘racialist’. Hegel's concept of race was the racialist concept of race. (shrink)

Three philosophical accounts of risk dominate the contemporary literature. On the probabilistic account, risk has to do with the probability of a disvaluable event obtaining; on the modal account, it has to do with the modal closeness of that event obtaining; on the normic account, it has to do with the normalcy of that event obtaining. The debate between these accounts has proceeded via counterexample-trading, with each account having some cases it explains better than others, and some cases that it (...) cannot explain at all. In this article, we attempt to break the impasse between the three accounts of risk through a shift in methodology. We investigate the concept of risk via the method of conceptual reverse-engineering, whereby a theorist reconstructs the need that a concept serves for a group of agents in order to illuminate the shape of the concept: its intension and extension. We suggest that risk functions to meet our need to make decisions that reduce disvalue under conditions of uncertainty. Our project makes plausible that risk is a pluralist concept: meeting this need requires that risk takes different forms in different contexts. But our pluralism is principled: each of these different forms are part of one and the same concept, that has a ‘core-to-periphery’ structure, where the form the concept takes in typical cases (at its ‘core’) explains the form it takes in less typical cases (at its ‘periphery’). We then apply our findings to epistemic risk, to resolve an ambiguity in how ‘epistemic risk’ is standardly understood. (shrink)

We argue that relating to myself as me provides, as such, a reason to care about myself: grasping that an event involves me, instead of another, makes it matter in a special way. Further, this self-concern is not simply a matter of seeing in myself some instrumental value for other ends. We use as our foil a recent skeptical challenge to this view offered in Setiya 2015. We think the case against self-concern is powered by unwarrantedly narrow construals of three (...) key notions. One is the notion of a first-personal way of relating to oneself. A narrow account of the first person in terms of special epistemic relations to oneself makes it easy to overlook a source of non-instrumental reasons of self-concern, located in the special relation a subject has to herself as agent. Two is the notion of what it is to be a reason. And, three, is the notion of self-concern itself. We show that the skeptical case rests in part on a slide towards neighbouring but distinct notions of egoism and selfishness. We also argue that Setiya’s notion of self-love, offered to capture the pre-theoretical intuition of self-concern, cannot do it justice. (shrink)

Viktor D. Kudryavtsev-Platonov is one of the most prominent representatives of Russian religious-academic philosophy of the second half of the nineteenth century whose theory of cognition bears an imprint of the Kantian theoretical philosophy. Kudryavtsev was not only thoroughly familiar with the Königsberg thinker’s work, but offered a critically reinterpreted version of Kant’s teaching on space, time and categories of understanding. But was the Russian philosopher original in his reading and critique of Kant? In his later works Kudryavtsev often cites (...) the works of Friedrich Adolf Trendelenburg whose works turn out to be very close to the Russian philosopher. Could it be that Kudryavtsev read Kant through Trendelenburg’s optics? To answer this question consistently I give outlines of Trendelenburg’s and Kudryavtsev’s theories of cognition and compare their views on the basis of the sources. I then draw on archive materials to characterise Kudryavtsev’s acquaintance with the works of Kant and Trendelenburg. It turns out that Kudryavtsev was well-versed in Kant’s philosophical ideas already in the early years of his teaching activities — but not from primary sources, but largely through German historical-philosophical renderings. I establish similarities between the teachings of Trendelenburg and Kudryavtsev on space, time and the categories of understanding and their critique of the relevant Kantian teaching. Finally, Kudryavtsev’s early manuscripts attest to his acquaintance with Trendelenburg’s ideas. I conclude that Trendelenburg influenced Kudryavtsev’s own theory of cognition, a fact that should be borne in mind when reading the Russian philosopher’s epistemological works. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Where Do Substantial Forms Come From?—A Critique of the Theistic Evolution of Mariusz Tabaczek*Michael Chaberek O.P. and Monika Metlerska-ColerickIntroductionThe question posed in the present article is whether it is possible to be a proponent of theistic evolution and, at the same time, of the metaphysical [End Page 239] principles elaborated by St. Thomas Aquinas. The authors of Thomistic Evolution: a Catholic Approach to Understanding Evolution in the Light of (...) Faith, recently published in Polish, imply that Aquinas's doctrine was not only compatible with the idea of biological macroevolution, but also—on some level—endorsed it.1 In his "Afterword" to the above publication, Mariusz Tabaczek points out certain deficiencies in the argumentation provided by its authors, simultaneously underlining that he agrees with the book's principal thesis.I will not examine the book by the American Dominicans in this article because I have already addressed their arguments in full in my book entitled Aquinas and Evolution,2 where I demonstrated that it is impossible to be both a proponent of theistic evolution and a follower of the philosophical views proposed by St. Thomas. In his "Afterword," Tabaczek presents a contradictory thesis. He claims that being both of the above is possible, provided that one modifies St. Thomas's teaching in four "essential aspects." The very approach of this kind already raises doubts. After all, if St. Thomas's doctrine indeed needs to be modified in order to reconcile his thought with evolution, it suggests that, in fact, it cannot be reconciled with it. Therefore, perhaps the problem comes down to asking whether the four points of incompatibility indicated by Tabaczek really constitute an "essential" part of Aquinas's doctrine? If it is not the case, they might be omitted or modified. If, however, they relate to certain essential elements of Aristotelian-Thomistic metaphysics, disregarding them equals denying St. Thomas's teaching and, consequently, makes it impossible to reconcile it with theistic evolution.In order to settle the problem, I devote the first part of my article to determining whether the points presented by Tabaczek refer to the essential elements of Aquinas's discourse. In the second part of my text, however, I move to a more important point, namely the fact that theistic evolution encounters many more problems in the context of Thomistic metaphysics. Since I have already addressed this matter in several places,3 I limit the scope [End Page 240] of the second part of my article to only one such problem: the emergence of new substantial forms (new species) via the mechanism of evolution. Thus, the object of the present analysis is to examine whether the solution suggested by Tabaczek provides an explanation to the problem of the origin of new substantial forms in theistic evolution.Commentary on the Four Points of IncompatibilityAccording to Tabaczek, the teaching of St. Thomas can be reconciled with theistic evolution under the conditions of:(1) recognizing the possibility of the emergence of new species, that is, acknowledging that the perfection of the universe can increase every day not only in terms of the number of individual beings, but also as regards the number of species; (2) emphasizing the fact that God's initial act of creation is limited to the derivation of matter of the lowest degree of complexity out of nothing (ex nihilo); (3) recognizing the fact that the processes of chemical, biochemical, and biological evolution belong to the work of adornment (opus ornatus), whose subsequent stages spread out across the entire history of the universe and, therefore, are not limited to a finished and past time period; and finally (4) acknowledging that God's direct intervention in the creation of the first representatives of plant and animal species (with the exception of man) is not necessary.4Ad (1) and ad (3). Points 1 and 3 boil down to the same idea, since they are both concerned with the fact that evolution continues, whereas from the Christian perspective, the divine work of creation had already finished. Using the symbiotic sustainability model as a framework, this research investigates how many and with which businesses top nonprofit organizations report partnerships. We examined the websites of the 122 largest, most recognizable U.S. nonprofits. These websites included information about 2,418 business–nonprofit partnerships with 1,707 unique businesses. The results suggest key differences with previous research on how U.S. Fortune 500 companies report B2N partnerships. Leading nonprofits report more B2N partnerships than U.S. Fortune 500 companies do. Furthermore, nonprofits do not maintain industry (...) exclusivity in reporting B2N partnerships, like their business counterparts do. Finally, social issue industries do not exert the same isomorphic pressures on B2N partnerships that economic industries do. New propositions that extend the symbiotic sustainability model are presented to account for nonprofits’ unique goals for capital accumulation in B2N partnering and the industry characteristics. This is a straightforward, elementary textbook for beginning students of philosophy. The general aim is to provide a clear introduction to the main issues arising in the philosophy of mind. Part I discusses the Cartesian dualist view which many find initially appealing, and contains a careful examination of arguments for and against. Part II introduces the broadly functionalist type of physicalism which has Aristotelian roots. This approach is developed to yield accounts of perception, action, belief and desire, and the emerging (...) theory of the mind is compared at each stage with rival historical and contemporary views. In Part III the functionalist approach is further explored in giving analyses of sensation, thought and freedom of will. The discussions throughout are exceptionally clear, and the writing uncomplicated, to make available to the students a wealth of detailed argument in the philosophy of mind. (shrink)

We write as Australian youth work educators. We consider some of the ethical challenges involved in teaching youth work ‘in a warm climate’, situated in the diaspora of English youth work but where youth work also has a uniquely Australian character, placing us in an ethically liminal space in our teaching between an understanding of youth work that is robustly defended as being both ‘good’ and ‘true’, and what we do, which is different from this, and has its own character (...) and strengths. We situate this in the policy history of youth work in Australia, particularly in the ‘neoliberal turn’ that this has taken in the last four decades which has created ethical challenges for us, just as it has for those elsewhere. Two guiding questions shape this paper. The first is, given our differences, what challenges do we face in maintaining connections with ‘good’ youth work and its value base as traditionally defined and defended in England, and relatedly, given that policy and funding regimes in the UK seem to be aligning more with an Australian model, is there anything that the youth work community in the UK can learn from the Australian experience? In lieu of an abstract, here is a brief excerpt of the content:Review Essay:Aquinas, Modern Theology, and the TrinityGuy Mansini O.S.B.As one would expect from his Incarnate Lord, Thomas Joseph White's Trinity is no exercise in historical theology, although of course it calls on history, but aims to give us St. Thomas's theology as an enduring and so contemporary theology that both respects the creedal commitments of the Catholic Church and offers a more satisfying understanding of the Trinity than anything (...) proposed by the great theologians, Catholic and Protestant, of the past hundred years.1 The Trinity, however, gives a more complete and satisfying view of its subject than does The Incarnate Lord.Can St. Thomas really be fruitfully located within the dialectic of nineteenth- and twentieth-century Trinitarian speculation? Yes, and it is one of White's principal contributions to show how St. Thomas's medieval contemporaries, the early Franciscans on the one hand and William of Ockham on the other, remotely but really adumbrate nineteenth- and twentieth-century theological positions, once due attention is paid to the key issues of the analogical naming of God and his knowability. The reader is thus assured that Aquinas's original project was composed with some awareness of temptations and alternatives repeated (though not exactly, of course) in modern thought. It should be added that St. Thomas is by no means treated as the only systematic theological authority for Trinitarian theology, but White recognizes his paradigmatic place in the Catholic theological tradition. [End Page 1415]The most important issue for assessing the enduring value of Thomas's Trinitarian theology, then, whether in the thirteenth century or twentieth century, turns out to be the applicability and centrality of the psychological analogy for an understanding of the immanent intelligibility of the Trinity, an analogy suggested by Scripture, and developed by the Cappadocians, St. Augustine, St. Thomas, and other medieval writers, not to mention John Henry Newman and Matthias J. Scheeben.What is the status of this analogy? Olivier-Thomas Venard laconically describes it as "revealed"—too hot. Michael Maria Waldstein has recently argued vigorously and at length that it is not revealed at all—too cold. White does not discuss this in detail but is satisfied with saying that it is "derived" from Scripture—just right. However one thinks this question is to be resolved, White robustly defends the psychological analogy as a proper analogy and as the only systematic theological instrument ever offered by the theological tradition that succeeds in providing real understanding of the immanent life of the Trinity, one that preserves the transcendence of God and honors the dogmatic tradition of the Church bearing on the nature of God and the Trinity of persons—Nicaea, Lateran IV, and Vatican I, especially. This is how he does it in chapter 22.1. We know the mystery of interior Trinitarian life based on God's manifestation of it to us in the economy of salvation via the missions of Word and Spirit, which disclose to us distinct personal processions.2. Such processions are either immanent or transitive.3. But transitive processions terminate in some substance distinct from whence they emanate.4. God, however, is one in nature (essence, substance) both specifically and numerically.5. Therefore, the processions are immanent to the godhead.6. However, there are only two immanent immaterial activities known to us, that of knowing and that of loving.7. Therefore, we cannot have some understanding of the mystery of interior Trinitarian life except by analogy with these two [End Page 1416] activities. Présenter aujourd’hui son parcours intellectuel revient à faire redécouvrir certains de ses travaux oubliés en esthétique afin de montrer leur singularité et leur cohérence profondément hégélienne, bien que ses recherches aient pris des formes très différentes et abordés avec érudition (...) des domaines très éloignés les uns des autres. Sans oublier de situer philosophiquement des aspects moins connus de ses activités, littéraires, artistiques et aussi institutionnelles avec sa contribution déterminante au développement de la discipline esthétique et à l’introduction des arts plastiques à l’université. Ce panorama n’aurait pas été complet si n’était pas signalée la place de ses recherches en paléontologie restées longtemps secrètes et a priori fort éloignées de l’esthétique. Alors que Bernard Teyssèdre avait publié en 2007 une nouvelle édition de son Roman de l’Origine revue et augmentée (et que Thierry Savatier était sur le point de publier une nouvelle édition de L’Origine du monde, Histoire d’un tableau de Gustave Courbet ), Jean Da Silva lui apprit qu’une photographie du tableau exposé au musée d’Orsay avait circulé en France pendant une vingtaine d’années avant d’être publiée en 1953 dans des revues oubliées ; ce qui bouleversait l’idée que l’on avait encore en 2009 de la connaissance de ce tableau. We propose a formal theory built upon an abstract argumentation framework for handling argumentation dynamics. To that end, we analyze the acceptability dynamics of arguments through the proposal of two different kinds of sets of arguments which are somehow responsible for the acceptability/rejection of a given argument. We develop a study of the consequences of breaking the construction of such sets towards the acceptance of an analyzed argument. This brings about the proposal of a novel change operation which allows to (...) determine which arguments should be removed from the framework so that another particular argument becomes accepted. Finally, the proposed model is formalized in the light of the theory of belief revision by characterizing the corresponding operations through constructive definition and an axiomatic characterization, connecting them through the corresponding representation theorem. The theoretical proposal constitutes the fundamentals for a system implementation in many dynamic domains of application. In particular, we show its application for handling the dynamics of legal interpretation. In that sense, this proposal constitutes a fundamental approach and theoretical justification to handle the dynamics of legal arguments through changes of interpretative canons. We show a possible concretisation of our abstract theory for the legal domain by analysing a real legal case from the Argentinean jurisprudence. Such a system would be capable of suggesting alternative critical points in the current state of affairs of a legal case towards pursuing a specific goal for which the case is being investigated. The American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct places ethical obligations upon psychologists based on another’s “age, gender, gender identity, race, ethnicity, culture, national origin, religion, sexual orientation, disability, language or socioeconomic status.” This article explores 18 major problems with ethical prescriptions contained in the Ethical Code involving this phrase, including problems in clarity, inconsistency, comprehensiveness, its epistemic assumptions, and its impossibility for adherence, among others.
